El presente trabajo de intervención, denominado “Protocolo de Atención a Migrantes Víctimas del Delito y de Violaciones a Derecho Humanos”, tiene como objetivo el contribuir al acceso a la justicia de migrantes que han sufrido la comisión de algún delito o la violación a derechos humanos, a través de la documentación eficiente del hecho delictivo o violatorio de derechos humanos y su posterior denuncia ante las autoridades competentes, dándole el seguimiento jurídico que permita el acceso de todos los derechos que como víctima le asisten al migrante.
La documentación del delito o de la violación se realizará independientemente del lugar donde se haya cometido el agravio
La metodología empleada fue Exploratoria y Descriptiva, llegando a la conclusión que las autoridades tienen un deber constitucional de respetar un conjunto de principios que permitan al gobernado gozar de todos los derechos y garantías que el orden jurídico mexicano y el derecho internacional de los derechos humanos le asignan.
La falta de acceso a la justicia que contribuye a la impunidad, es un problema estructural, donde el principal ingrediente es el factor humano con el que hay que incidir para acceder a niveles de justicia.
Debida Diligencia. Este concepto se refiere a un principio acuñado por la Corte Interamericana de Derechos Humanos y que se refiere a la posibilidad de que a un estado miembro se le pueda fincar responsabilidad internacional por hechos cometidos por actores no estatales. Este principio establece la obligación del estado de ser diligentes en la investigación de violaciones graves a derechos humanos.
Acceso a la Justicia. El acceso a la justicia, se constituye en un derecho consagrado en la Constitución Mexicana y en la Convención Americana sobre Derechos Humanos y que garantiza la existencia de instituciones para permitir una justicia, pronta y expedita.
Protocolo. Es un documento que establece un conjunto de reglas que se deben seguir para alcanzar determinados objetivos o establecer de manera indubitable una meta. Se traduce en un manual de procedimiento para documentar de manera fehaciente un evento.
This intervention paper, called “Attention to Crime and Human Rights Violation Immigrants Protocol” aims to contribute to the access to justice by immigrants who have suffered from a crime or human rights violation, through the correct documentation of the crime or human rights violation and its complaint to the authorities, providing the legal follow up that allows the access of every right that the immigrant is entitled to, being the victim.
The documentation of the crime or the violation will be carried out with disregard for the place where the fault was committed. The methodology for this work was both exploratory and descriptive, arriving to the conclusion that the authorities have a constitutional duty to respect the principles that allow the citizen to be protected by all the rights and guarantees that the Mexican justice system and International Human Rights Law provide.
The lack of access to justice which contributes to impunity, is a structural problem, where the key ingredient is the human factor, which must be considered to access to different levels of justice.
Due diligence: This concept refers to a principle stated by the Interamerican Court of Human Rights and refers to the possibility for a member state to be attributed with international responsibility by acts carried out by non-state actors. This principle establishes the obligation of the state to be diligent in the investigation of severe violations to human rights.
Access to justice: The Access to justice constitutes a right contained in the Mexican Constitution and the American Convention on Human Rights, which guarantees the existence of institutions to allow a quick justice.
Protocol: A document that establishes a series of rules that must be followed in order to reach certain objectives or to establish a certain goal. It translates to a proceedings manual to faithfully certify an event.
